Terms of Service

1. Seller and acceptance

These Terms of Service are between you and Kris Green, trading as Misled ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Misled website and services, you agree to these terms. If you do not agree, please do not use the service.

2. What Misled provides

Misled is an online variety-cryptic crossword puzzle site. We publish puzzles, provide solving tools, and offer a paid membership ("Misled Club") that unlocks the full puzzle library and co-solving features.

3. Use of the service

You may use Misled for personal, non-commercial enjoyment. You must not:

  • use the service for any unlawful purpose or in violation of applicable laws;
  • send spam, harass other users, or impersonate anyone;
  • infringe intellectual property rights, including copying or redistributing puzzles or content without permission;
  • interfere with the security or availability of the service, including probing, scraping, or introducing malware;
  • share account credentials, reverse-engineer any part of the service, or circumvent access controls.

You are responsible for keeping your account credentials secure and for all activity under your account.

4. Payments and subscriptions

Misled Club is a recurring subscription. Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Your subscription renews automatically until you cancel it through your account or Paddle's customer portal.

5. Intellectual property

Misled owns all rights in the website, software, puzzles, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to access and use the service within the scope of your membership. You may not reproduce, resell, or redistribute puzzle content or code.

6. Service level

We aim to keep Misled available and enjoyable, but we do not guarantee uninterrupted or error-free performance. We may update, change, or remove features as we improve the service.

7. Termination and suspension

We may suspend or terminate your access if you materially breach these terms, fail to pay subscription fees, create a security or fraud risk, or repeatedly or seriously violate our policies. Upon termination, your right to access the service ends, but provisions relating to intellectual property, liability, and governing law survive.

8. Warranties and liability

The service is provided "as is". To the extent permitted by law, we disclaim all implied warranties and exclude liability for indirect, consequential, or special damages. Nothing in these terms excludes liability for fraud, death, or personal injury where required by law.

9. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and any dispute will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

10. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by posting the updated terms on this page with a new effective date. Continued use of the service after changes means you accept the revised terms.
